Starting today, Uttarakhand becomes the first state after Goa to implement a Uniform Civil Code (UCC), aiming to create uniform laws for marriage, divorce, property rights, inheritance, and adoption for all its residents. The move is part of the BJP’s election promise during the 2022 state polls and is set to bring significant legal reforms.

One of the key provisions of the UCC includes mandatory registration for live-in relationships, with parental consent required for individuals under the age of 21. Those failing to register live-in relationships or providing false information could face up to three months in jail or a fine of Rs 25,000, or both. Additionally, any delay in registration could lead to a fine of Rs 10,000 and a potential jail term.

The Code also standardizes marriage registration, setting the minimum marriage age at 21 for men and 18 for women, ensuring that individuals can complete their education before marriage. It also bans polygamy, child marriage, triple talaq, and sets a uniform process for divorce. The UCC does not apply to Scheduled Tribes.

Another significant aspect of the law is its provisions for inheritance rights, ensuring equal treatment for all children, including those born out of live-in relationships. The UCC also removes gender distinctions by referring to both sons and daughters as “children” in inheritance matters.

Moreover, practices like nikah halala and iddat, which were traditionally followed by some Muslim communities, are also banned under the new law, aiming to ensure equality and fairness in family law practices.
